WHAT YOU SHOULD KNOW:


Blood Alcohol Concentration (BAC) Limits:

  • The legal BAC limit for drivers 21 years and older is 0.05% FOR A DWAI AND 0.08% FOR A DUI.

Penalties for DUI:

  • First-time DUI offenders may face penalties such as fines, license suspension, mandatory alcohol education, and possibly jail time.
  • Penalties become more severe for subsequent DUI offenses, with longer license suspensions and mandatory jail time for repeat offenders.

Express Consent Law:

  • Colorado has an "express consent" law, which means that by obtaining a Colorado driver's license, you have already given your consent to chemical testing (blood, breath, or urine) if you are suspected of DUI/DUID. Refusing to take a chemical test can result in an automatic license suspension.

Ignition Interlock Device (IID):

  • In Colorado, an IID may be required for certain DUI offenders, even for first-time offenses. This device measures BAC before allowing the vehicle to start and may be mandatory as a condition of regaining driving privileges.

Marijuana DUI/DUID:

  • Colorado has legalized recreational marijuana use, but it is illegal to drive while impaired by marijuana. Law enforcement officers may use blood tests to determine marijuana impairment.
